Introduction

These Terms and Conditions (“Terms”) govern your access to and use of AIWizly, including our website, mobile applications, educational content and related services (together, the “Service”).

Please read these Terms carefully before creating an account, creating a child profile or purchasing a subscription.

AIWizly is operated by AIWIZLY LIMITED, a company registered in England and Wales under company number 16500442, with its registered office at 64 Southwark Bridge Road, London, England, SE1 0AS (“AIWizly”, “we”, “us” or “our”). You can contact us at info@aiwizly.com.

By creating an AIWizly account, purchasing a subscription or otherwise using the Service, you agree to these Terms. If you do not agree to these Terms, you should not use the Service.

1. About AIWizly

AIWizly is an educational platform designed to help children learn, practise their knowledge and explore age-appropriate topics through curated questions, activities and educational content.

Content provided to children through AIWizly is manually selected, reviewed and curated with the intention of making it appropriate for the relevant age groups.

Despite the AIWizly name, the current Service does not use artificial intelligence to generate questions, educational content or responses presented to children.

AIWizly is intended to supplement learning and encourage curiosity. It is not intended to replace formal education, professional teaching, parental involvement or advice from suitably qualified professionals.

2. Who May Create an Account

The main AIWizly account must be created and controlled by an adult.

An account holder must be:

  • at least 18 years old;
  • a parent or legal guardian;
  • an adult authorised by a parent or legal guardian; or
  • where applicable, an authorised representative of a school or educational organisation.

Children may not independently create the main account, enter into a subscription contract with AIWizly or provide payment information.

The adult who creates the account is the “Account Holder” and enters into these Terms with AIWizly.

Your confirmations when creating an account

By creating an account, you confirm that:

  • you are at least 18 years old;
  • the information you provide is accurate and complete;
  • you have authority to create and manage any child profile associated with your account;
  • where you create a profile for a child, you are legally entitled to do so; and
  • you accept responsibility for managing the account in accordance with these Terms.

3. Child Profiles

An Account Holder may create one or more child profiles, subject to any limits applicable to the relevant subscription plan.

A child profile enables a child to access educational content selected for their profile and age or learning level.

A child profile does not create a separate contractual relationship between the child and AIWizly. The contractual relationship remains between AIWIZLY LIMITED and the adult Account Holder or, where applicable, the relevant educational organisation.

The Account Holder is responsible for:

  • creating and managing child profiles;
  • providing accurate information when setting up those profiles;
  • selecting appropriate profile settings;
  • deciding whether the Service and particular learning content are suitable for the child;
  • appropriately supervising the child’s use of AIWizly; and
  • protecting login details, access codes and other account credentials.

Children should not be asked to provide information through AIWizly unless the Service specifically requests it as part of an age-appropriate feature.

4. Children’s Safety and Privacy

The wellbeing and privacy of children are fundamental considerations in the design and operation of AIWizly.

We aim to collect and process only the personal information reasonably necessary to operate and provide the Service.

Where children interact directly with AIWizly, we aim to present information and controls in a way that is appropriate to their likely age and understanding.

AIWizly is not intended to operate as an unrestricted social network or public communication service for children.

Unless we expressly introduce such functionality in the future, children cannot use AIWizly to:

  • publicly publish their personal information;
  • communicate openly with unknown adults or other users;
  • publicly post photographs, videos or messages;
  • participate in public chat rooms; or
  • make purchases independently.

Where parental controls allow an Account Holder to view or manage elements of a child’s activity, we may provide the child with age-appropriate information explaining that such parental controls exist.

Details of how we collect, use, store and protect personal information are set out in our Privacy Policy.

5. Educational Content

AIWizly provides educational questions, learning activities, explanations and related materials.

We take reasonable steps to review and curate our content for its intended audience.

However, children develop and learn at different rates, and parents and guardians may have different views about whether particular topics or materials are appropriate for an individual child.

We therefore cannot guarantee that every item of content will be suitable for every child within a particular age group.

Educational content may also occasionally contain errors, omissions or outdated information.

If you believe that content available through AIWizly is inaccurate, inappropriate, unsuitable for its intended age group or otherwise concerning, please contact us at info@aiwizly.com. We may investigate, correct, restrict, replace or remove content where appropriate.

6. Virtual Items and Rewards

AIWizly includes gamified features, such as earning stars, hatching and caring for virtual pets, and collecting other in-app rewards.

These virtual items are part of the Service. They have no real-world monetary value, cannot be exchanged for cash and cannot be transferred outside the Service.

We may add, adjust or retire gamified features as the Service develops.

7. No Professional Advice

AIWizly provides educational information and activities only.

Unless expressly stated otherwise, content available through AIWizly does not constitute:

  • medical advice;
  • psychological or mental-health advice;
  • legal advice;
  • financial advice;
  • safeguarding advice; or
  • other regulated professional advice.

You should seek advice from an appropriately qualified professional where professional advice is required.

8. Subscriptions

Access to some or all parts of AIWizly may require a paid subscription.

The available subscription plans, price, billing period and included features will be presented to the Account Holder before a subscription is purchased.

Only an adult Account Holder may purchase or manage a subscription. Children must not enter payment details or independently make purchases through AIWizly.

Depending on how you access AIWizly, subscriptions may be processed:

  • directly by AIWizly or our payment processor;
  • through the Apple App Store;
  • through Google Play; or
  • through another authorised application marketplace or payment provider.

Where a third-party platform processes a subscription, its payment and billing terms may also apply.

9. Automatic Renewal

Where a subscription is described as automatically renewing, it will continue for successive billing periods unless it is cancelled.

Before you purchase an automatically renewing subscription, we will display the relevant pricing and billing information.

Unless otherwise stated when you purchase the subscription, cancelling a subscription prevents future renewal charges but does not normally terminate access for a period that has already been paid for. You may therefore continue to use the relevant subscription features until the end of the current paid billing period.

You can cancel a subscription using the cancellation mechanism made available within your account or, where the subscription was purchased through a third-party platform, through the relevant platform’s subscription-management service. For example, subscriptions purchased through Apple’s App Store or Google Play will generally need to be managed using the subscription controls provided by that platform.

Deleting the AIWizly application from a device does not necessarily cancel an active subscription. Deleting an AIWizly account also may not automatically cancel a subscription administered by a third-party app store. You should cancel any active subscription separately before deleting your account.

10. Free Trials and Promotions

AIWizly may offer free trials, discounted subscriptions or promotional offers from time to time.

Any specific conditions applying to an offer will be displayed before you accept it.

Where a free or discounted trial will automatically become a paid subscription, we will make this clear before the trial starts, together with the price and billing frequency that will apply afterwards.

You can cancel before the end of the trial using the applicable subscription cancellation mechanism to prevent the subscription from renewing into a paid period.

Promotional offers may be subject to eligibility requirements and may be limited to one per person, Account Holder, household or payment method where stated.

11. Consumer Cancellation Rights

Nothing in these Terms affects any statutory rights you have as a consumer.

Depending on the nature of the subscription and how it is supplied, consumers may have statutory rights to cancel contracts entered into online.

Where you ask us to begin supplying digital content or digital services immediately, we may ask you during checkout to expressly consent to supply beginning during any applicable statutory cancellation period and to acknowledge the consequences this may have for your right to cancel.

Where required by law, we will provide the relevant information before you complete your purchase.

Where you purchase a subscription through Apple, Google or another third-party marketplace, cancellation and refund requests may also be handled under that platform’s processes and applicable terms.

Nothing in these Terms removes or restricts rights that cannot lawfully be excluded.

12. Refunds

Refund eligibility depends on applicable consumer law, the circumstances of the purchase and, where relevant, the rules of the platform through which the subscription was purchased.

Where you purchased directly from AIWizly, you may contact us at info@aiwizly.com if you believe you are entitled to a refund.

Where a subscription was purchased through Apple, Google or another third-party payment platform, you may need to request a refund directly from that provider.

Nothing in this section affects any statutory right you may have to a refund or other remedy.

13. Changes to Subscription Prices

We may change subscription prices from time to time.

Changes will not retrospectively increase the price of a subscription period for which you have already paid.

Where a price change affects an automatically renewing subscription, we will provide notice where required by law or by the rules of the payment provider through which the subscription was purchased.

Where applicable, you will have the opportunity to cancel before a new subscription price becomes effective.

14. Account Security

You are responsible for maintaining the security of your account.

You must take reasonable steps to protect passwords, PINs, access codes and other credentials associated with your account.

You must not knowingly allow an unauthorised person to use your adult Account Holder credentials.

Please contact us promptly at info@aiwizly.com if you believe:

  • your account has been accessed without permission;
  • account credentials have been compromised;
  • a child has gained unauthorised access to adult account controls; or
  • there is another security concern relating to your account.

15. Acceptable Use

You must use AIWizly lawfully and responsibly.

You must not use or attempt to use AIWizly to:

  • engage in unlawful, fraudulent or abusive activity;
  • harm, exploit or endanger a child or another person;
  • gain unauthorised access to accounts, systems or data;
  • circumvent security measures or access restrictions;
  • interfere with the operation or security of the Service;
  • introduce viruses, malware or malicious code;
  • scrape, harvest or systematically extract substantial amounts of AIWizly content without our permission;
  • reproduce the Service for commercial purposes without authorisation;
  • reverse engineer or attempt to obtain source code except where expressly permitted by law;
  • impersonate another person; or
  • use AIWizly in a manner reasonably likely to harm AIWizly, its users or its infrastructure.

We may restrict or suspend access where we reasonably believe these Terms are being breached.

16. Intellectual Property

AIWizly, its licensors and content providers own or have the appropriate rights to the intellectual property used within the Service.

This may include rights relating to:

  • educational questions;
  • learning activities;
  • explanations;
  • written content;
  • illustrations;
  • graphics;
  • user-interface designs;
  • software;
  • databases;
  • logos;
  • trademarks; and
  • other materials made available through AIWizly.

A subscription gives you permission to use the Service. It does not transfer ownership of AIWizly or its content to you.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use AIWizly for personal, family or authorised educational purposes.

You must not reproduce, republish, sell, license, distribute or commercially exploit substantial portions of AIWizly or its educational content without our written permission, except where applicable law permits you to do so.

17. Feedback

If you provide suggestions, ideas, comments or feedback about AIWizly, we may use that feedback to develop or improve the Service.

Providing feedback does not transfer ownership of your existing intellectual property to us.

You are not required to provide feedback.

18. Schools and Educational Organisations

AIWizly may allow schools, teachers or other educational organisations to create or administer accounts.

Where an individual creates an account on behalf of an organisation, that individual confirms that they have authority to act on behalf of the organisation.

Additional terms may apply to organisational use of AIWizly, including terms dealing with:

  • pupil accounts;
  • administration;
  • data protection responsibilities;
  • data processing;
  • safeguarding responsibilities;
  • subscriptions;
  • user provisioning; and
  • termination.

Where AIWIZLY LIMITED enters into a separate written agreement with an educational organisation, that agreement will take precedence over these Terms to the extent that there is any conflict.

The organisation remains responsible for obtaining any permissions or authorisations it is legally required to obtain before providing pupil information to AIWizly.

19. Privacy and Personal Data

We process personal data in accordance with our Privacy Policy and applicable data protection law.

Because AIWizly is designed for use by children, we take children’s privacy particularly seriously.

Our approach includes seeking to:

  • collect only personal information reasonably necessary to provide the Service;
  • use appropriate privacy settings for child users;
  • restrict unnecessary sharing of children’s information;
  • provide appropriate parental controls;
  • protect account information using appropriate technical and organisational measures; and
  • provide understandable information about how personal information is used.

Where appropriate, we may provide a separate age-appropriate privacy notice or explanation for children.

Our Privacy Policy forms part of the information you should review before creating child profiles.

20. Service Availability

We aim to keep AIWizly available and functioning reliably, but we cannot guarantee uninterrupted availability.

Access may occasionally be affected by:

  • maintenance;
  • updates;
  • server or network failures;
  • security incidents;
  • failures of third-party infrastructure;
  • app-store availability;
  • events outside our reasonable control; or
  • other technical issues.

We may temporarily suspend parts of the Service where reasonably necessary to maintain, secure or improve it.

21. Changes to the Service

We expect AIWizly to develop over time.

We may:

  • add features;
  • improve existing features;
  • change the user interface;
  • add or remove educational content;
  • update age classifications or learning categories;
  • correct errors;
  • modify technical requirements; or
  • discontinue features that are no longer practical to maintain.

We will take reasonable steps to avoid materially reducing the core functionality of a paid subscription during a period that has already been purchased.

Where a significant change materially affects a paid Service, we will provide notice where required by law.

22. Third-Party Services

AIWizly may depend on third-party services for functions such as:

  • hosting;
  • payment processing;
  • application distribution;
  • authentication;
  • email delivery;
  • analytics;
  • security; and
  • technical infrastructure.

Those providers may have their own terms and privacy policies.

We remain responsible for our obligations to you under applicable law, but we cannot guarantee the uninterrupted operation of third-party systems outside our reasonable control.

23. Closing Your Account

The adult Account Holder may request closure of their AIWizly account using any account-deletion facility provided within the Service or by contacting info@aiwizly.com.

Closing an adult account may also result in associated child profiles becoming inaccessible or being deleted or anonymised, subject to our Privacy Policy and any legal retention obligations.

Account deletion and subscription cancellation may be separate processes.

If you have an active subscription, particularly one administered by an app store or other third party, you should cancel that subscription separately before deleting your AIWizly account.

24. Suspension and Termination by AIWizly

We may suspend, restrict or terminate access to AIWizly where we reasonably believe:

  • these Terms have been materially or repeatedly breached;
  • the Service is being used unlawfully;
  • an account creates a security risk;
  • activity presents a safeguarding or child-safety concern;
  • payment legitimately due remains unpaid;
  • fraudulent activity is suspected; or
  • suspension or termination is required by law.

Where appropriate, we will attempt to provide reasonable notice and an opportunity to resolve the issue.

We may take immediate action where we reasonably consider it necessary to protect children, other users, AIWizly or the security of the Service.

25. Our Responsibility to You

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation; or
  • any liability that cannot legally be excluded or limited.

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breaching these Terms or failing to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if, when the contract was made, both you and we knew that it might happen. We are not responsible for losses that are not reasonably foreseeable.

AIWizly is intended primarily for personal and educational use. Except where separately agreed with an educational organisation or business customer, we are not responsible for business losses arising from consumer use of AIWizly, including loss of profits, revenue, business opportunities or anticipated savings, to the extent permitted by law.

Nothing in these Terms affects your statutory consumer rights.

26. Educational Outcomes

AIWizly is intended to support learning, but educational outcomes depend on many factors outside our control.

We therefore do not guarantee that use of AIWizly will:

  • achieve a particular academic result;
  • improve examination results;
  • ensure progression to a particular educational level;
  • identify every gap in a child’s knowledge; or
  • replace teaching or structured educational assessment.

Parents, guardians, teachers and schools remain responsible for educational decisions relating to individual children.

27. Communications

We may contact an Account Holder about matters relating to their account or the Service, including:

  • account security;
  • subscription or payment matters;
  • significant Service changes;
  • changes to these Terms or our Privacy Policy;
  • legal or regulatory notices; and
  • important operational information.

Where required by applicable law, marketing communications will be sent only where we have an appropriate basis to do so.

You may unsubscribe from optional marketing communications using the unsubscribe mechanism provided with those communications.

Operational and account-related communications may still be sent where necessary to provide the Service.

28. Changes to These Terms

We may update these Terms from time to time. Reasons for doing so may include:

  • changes to AIWizly;
  • changes to our subscriptions;
  • new functionality;
  • changes in law or regulation;
  • security requirements; or
  • clarifying existing provisions.

The date shown at the top of these Terms indicates when they were most recently updated.

Where a change materially affects your rights or obligations, we will provide reasonable advance notice where appropriate and required by law.

If you do not agree to a material change, you may stop using AIWizly and cancel your subscription.

Changes will not remove statutory consumer rights.

If you have a complaint about AIWizly, please contact us so that we can try to resolve it.

We will aim to investigate complaints fairly and respond within a reasonable period.

Nothing in this section prevents you from exercising any statutory right or contacting an appropriate regulator or dispute-resolution body.

30. Governing Law and Jurisdiction

If you are a consumer living in England or Wales, these Terms are governed by English law and you may bring legal proceedings in the courts of England and Wales.

If you live in Scotland, you may bring proceedings in Scotland or England.

If you live in Northern Ireland, you may bring proceedings in Northern Ireland or England.

If you live outside the United Kingdom, you may also benefit from mandatory consumer protections under the laws of your country of residence that cannot lawfully be excluded by these Terms.

For schools, organisations and other non-consumer customers, unless otherwise agreed in writing, these Terms are governed by the laws of England and Wales and the courts of England and Wales have exclusive jurisdiction.

31. General

If any provision of these Terms is held to be unlawful, invalid or unenforceable, the remaining provisions will continue in effect.

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

You may not transfer your rights or obligations under these Terms to another person without our written consent.

We may transfer our rights or obligations as part of a sale, merger, restructuring or transfer of the AIWizly business, provided that doing so does not reduce your statutory rights.

These Terms, together with our Privacy Policy, any subscription information presented at the time of purchase and any separate organisational agreement that applies, constitute the agreement governing your use of AIWizly.
